NOT GUILTY AFTER TRIAL
Motor Vehicle Homicide by Negligent Operation; Milford District Court; Commonwealth v. T.W.; March 22, 2024
Mendon Police and Massachusetts State Police were dispatched for a reported motor vehicle accident involving an SUV and a motorcycle. Upon arrival, the investigating officers observed in the roadway a heavily damaged SUV and a motorcycle laying on its side. The operator of the motor vehicle was seriously injured and succumbed to his injuries shortly thereafter. During the course of the subsequent investigation, the Massachusetts State Police Accident Reconstruction Team undertook to evaluate the scene and ultimately opined that the Defendant failed to use due care when entering the intersection and caused the collision with the motorcycle.
Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the Reconstruction Expert, challenge the state of the evidence, and defeat the allegations. As such, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
