NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Quincy District Court; Commonwealth v. D.G.; February 20, 2024
Cohasset Police were dispatched to the business complex of 130 King Street along Route 3A in the town of Cohasset for a report of unsupervised dogs running throughout the parking lot. Upon arrival, the officers located the Defendant as he attempted to gain control of the dogs. While interacting with the Defendant the officers observed the defendant to smell strongly of alcohol, walk unsteady on his feet, have blood shot eyes, and speak with slurred speech. After an argument with the police about his dogs, the defendant was failed a series of field sobriety tests and was placed was under arrest for operating under the influence of alcohol.
Notwithstanding all of the above, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
After the Defendant was acquitted of the charges, Attorney Ciraulo filed and the Court allowed a motion to reinstate / restore the Defendant's driver's license as said license was suspended as a result of his refusal to perform the breath test.
