NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Quincy District Court; Commonwealth v. B.G.; April 30, 2024
Weymouth Police Officers were dispatched to investigate a single car motor vehicle accident (SUV v. Telephone Pole). Upon arrival, the officers observed the Defendant standing alongside a heavily damaged SUV with said SUV fully off of the roadway, against a concrete barrier wall, and pressed firmly against a damaged utility pole. During the course of the investigation, the police identified the Defendant as the operator of the SUV, made observations consistent with the consumption of alcohol (odor of alcohol about the Defendant's person and bloodshot and glassy eyes), and formed the opinion the Defendant was under the influence. After additional conversation, the Defendant was placed under arrest, handcuffed, searched, and transported back to the police station for processing.
Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officer, challenge the state of the evidence, and defeat the allegations against the Defendant. As such, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
