NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol' Waltham District Court; Commonwealth v. H.B.; February 1, 2024
While on patrol, Waltham Police Officers observed the Defendant traveling at a high rate of speed and improperly between lanes. The officers attempted to stop the Defendant, but lost site of her car as she sped away. A short distance away, the Defendant thereafter struck the curbing and a street sign and came to a stop. The police officers approached the Defendant, made observations of her consistent with the consumption of alcohol, and administered to her a series of field sobriety tests. The failed to perform the tests properly and admitted she had consumed a couple of drinks. The Defendant was thereafter arrested and charged with a operating under the influence of alcohol, second offense.
Notwithstanding all of the above, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
