Leaving the Scene of an Accident After Causing Property Damage; Barnstable District Court; Commonwealth v. M.M.; January 26, 2024. 

Barnstable Police were dispatched to investigating the report of a motor vehicle accident involving multiple vehicles and a cyclist. Upon arrival, the witnesses report that a vehicle rear ended another, struck a cyclist, and thereafter fled the scene. The investigating officers undertook an investigation and ultimately concluded that the Defendant was the operator involved. 

Attorney Ciraulo drafted, filed, and argued a Motion to Dismiss pursuant to M.G.L. 90C s. 2 (The "No Fix Law") asserting that the requisite procedures relative to the recording of a motor vehicle offense and issuance of a citation were not properly followed. The Court agreed and the case against the Defendant was dismissed.
