NOT GUILTY AFTER TRIAL

Operating Under the Influence of Alcohol, Third Offense; Barnstable District Court; Commonwealth v. J.S.; June 10, 2026 

Sandwich Police Officers were dispatched to investigate a report of a pickup truck striking a telephone pole. Upon arrival, the investigating officers observed the Defendant standing alongside his heavily damaged pickup truck. The Defendant was unsteady on his feet, smelled of alcohol, had blood shot and glossy eyes, and spoke with slurred speech. The Defendant was unable to perform the alphabet field sobriety test to the satisfaction of the officers. Ultimately the officers formed the opinion that the Defendant was under the influence of alcohol and placed him under arrest.

Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officers, challenge the state of the evidence, and defeat the allegations against the Defendant. As such, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.

In addition, Attorney Ciraulo filed a motion to restore the Defendant's license, argued that the Defendant did not pose a threat to public safety, and successfully vacated a three year license suspension.
