NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Quincy District Court; Commonwealth v. J.H.; April 21, 2026
Milton Police Officers were dispatched to investigate a report of an erratic operator. The investigating officer located the vehicle parked along the side of the roadway. Upon approach, the officer observed the Defendant seatedin the driver's seat of the vehicle with his head slumped into his chest. After the officer knocked on the window several times, the Defendant slowly came to and rolled down the window. The Defendant smelled strongly of alcohol, had blood shot and glassy eyes, could not formulate complete sentences, and slurred his words. In addition, the Defendant could not produce his license upon request and presented as extremely unsteady in his feet as he exited the vehicle. Ultimately the officer formed the opinion that the Defendant was "extremely intoxicated" and placed him under arrest for operating under the influence of alcohol.
Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officer, challenge the state of the evidence, and defeat the allegations against the Defendant. As such, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
