Operating Under the Influence of Alcohol; Orleans District Court; Commonwealth v. C.B.; March 31, 2026

A Trooper with the Massachusetts State Police was on Route 6 in Dennis conducting an unrelated motor stop when the Defendant passed the Trooper's cruiser at a high rate of speed and in such close proximity that the Defendant caused the Trooper's cruiser to shake. The Trooper pursued the Defendant for five miles at one hundred plus miles per hour before catching up to the Defendant and conducting a stop of the Defendant's car. The Defendant presented with an strong odor of alcohol, slurred speech, and bloodshot eyes. The Defendant acknowledged consuming three "jack and cokes." The Defendant was thereafter ordered out the car and administered the Nine Step Walk and Turn, One Leg Stand, Alphabet, and Counting Backwards test - all of which the Defendant failed to perform to the satisfaction of the Trooper(s) now on scene. The Defendant was arrested and transported back to the barracks for processing. During the booking process the Defendant consented to the administration of the Breath Test and the reading was .21 % (almost three times the legal limit of .08 %). 

Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officer, challenge the state of the evidence (including a challenge to the scientific reliability / proper administration of the Breath Test), and defeat the allegations against the Defendant. As such, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
