Operating Under the Influence of Alcohol; Barnstable District Court; Commonwealth v. B.L.; December 18, 2025

A Massachusetts State Trooper observed the Defendant speeding and undertook to conduct a motor vehicle stop. The Defendant moved into the left hand turn only lane and stopped within the lane of travel. The investigating Trooper instructed the Defendant to move the car out of the roadway / lane of travel and pull into a nearby has station. After the vehicle was stopped, the Trooper approached and observed an odor of alcohol about the Defendant, bloodshot and glassy eyes, slurred speech, and slow / delayed movements. In addition, the Defendant swayed from side to side, was unsteady, and struggled to maintain balance once outside of the car. The Trooper administered to the Defendant a series of field sobriety tests and thereafter placed the Defendant under arrest for the offense of operating under the influence of alcohol. During the course of the booking procedure, the Defendant agreed to take a breath test ("breathalyzer") and the reading was .17 (more than double the legal limit of .08). 

Notwithstanding all of the above, Attorney Ciraulo was able to challenge the state of the evidence and defeat the allegations against the Defendant as the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt. As such, the Defendant was found Not Guilty after trial.
