NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Brockton District Court; Commonwealth v. T.S.; March 18, 2026
Abington Police Officers, while on patrol in a high traffic enforcement area, observed the Defendant traveling almost double the posted speed limit and cross of the center dividing line into the oncoming lane of travel. The officers conducted a motor vehicle stop. During the course of the interaction the Defendant presented unorganized and confused, had about his person and breath a strong odor of alcohol, and slurred his speech. When ordered out of the car, the Defendant tripped over his legs in a criss cross fashion and had to regain his balance. After the Defendant was arrested and transported back to the police station for processing, the Defendant consented to a breath test ("breathalyzer") and the result was 08% (over the legal limit).
Notwithstanding all of the above, Attorney Ciraulo was able to challenge the state of the evidence and defeat the allegations against the Defendant as the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt. As such, the Defendant was found Not Guilty after trial.
