NOT GUILTY AFTER TRIAL

Operating Under the Influence of Alcohol; Plymouth District Court; Commonwealth v. T.S.; November 4, 2025

Plymouth Police Officers were dispatched to investigate a report of a single car motor vehicle accident on Water Street in the town of Plymouth. Upon their arrival, the Officers observed the Defendant seated behind the wheel of heavily damaged sedan. It was clear from the debris field and the roadway evidence that the Defendant travelled past a road closed sign, through a construction zone, and thereafter struck a stone wall and granite light post. When interacting with the Defendant, the police observed a strong odor of alcohol, slurred speech, and bloodshot and glassy eyes. Once outside of the vehicle, the Defendant swayed from side to side, was unsteady on his feet, struggled to maintain his balance, and could not initially locate his license. Ultimately, the Defendant was placed under arrest and charged with operating under the influence of alcohol.

Notwithstanding all of the above, Attorney Ciraulo was able to challenge the state of the evidence and defeat the allegations against the Defendant as the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt. As such, the Defendant was found Not Guilty after trial.
