NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Chelsea District Court; Commonwealth v. B.P.; October 1, 2025
Chelsea Police Officers were dispatched for a report on an individual stopped at a stop light and passed out behind the wheel. Upon their arrival, the officers observed the Defendant seated inside of a car with her head "slumped across the center console." The officers undertook to wake up the driver by shaking the car, knocking on the windows, yelling, and using a glass-breaking tool. Ultimately, the Defendant slowly woke up, but appeared confused and had a difficult time understanding instructions. While interacting with the Defendant, the officers observed a very strong odor of alcohol, blood shot and glassy eyes, and slurred speech. Ultimately, the Defendant was placed under arrest and charged with operating under the influence of alcohol.
Notwithstanding all of the above, Attorney Ciraulo was able to challenge the state of the evidence and defeat the allegations against the Defendant as the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt. As such, the Defendant was found Not Guilty after trial.
