NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Falmouth District Court; Commonwealth v. H.K.; September 30, 2025
Falmouth Police Officers were dispatched to investigate a two car motor vehicle crash on Route 151. Upon arrival, the investigating officers learned that the Defendant failed to stop at the intersection and collided with another motorist. The officers observed about the Defendant a strong odor of alcohol and slurred speech. When questioned, the Defendant acknowledged consuming two glasses of wine. After the Defendant failed a series of field sobriety tests, including the alphabet test and the counting backwards test, she was placed under arrest and charged with operating under the influence of alcohol. At the police station, the Defendant consented to the breathalyzer "breath test" and the machine returned a reading of .11% (over the legal limit of .08%).
Notwithstanding all of the above, Attorney Ciraulo was able to challenge the state of the evidence and defeat the allegations against the Defendant as the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt. As such, the Defendant was found Not Guilty after trial.
