NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Quincy District Court; Commonwealth v. S.D.; July 17, 2025
The Defendant was stopped at an Operating Under the Influence / Sobriety checkpoint in the town of Weymouth. The Massachusetts State Police Troopers conducting the investigation smelled an odor of alcohol from within the vehicle and ordered the Defendant to proceed into the "PIT" for further investigation. Inside the "PIT," the Defendant was questioned, ordered out of the vehicle, and asked to participate in a series of field sobriety tests. Ultimately, the Troopers formed the opinion that the Defendant was under the influence of alcohol and the Defendant was placed under arrest, handcuffed, searched, and transported for processing.
Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officer and challenge the state of the evidence. Ultimately, Attorney Ciraulo was able defeat the allegations against the Defendant, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt, and the Defendant was found Not Guilty after trial.
