NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Plymouth District Court; Commonwealth v. T.K.; September 17, 2025
Pembroke Police Officers received information that the Defendant was involved in a motor vehicle accident at a local drive-thru and thereafter fled the scene. Ultimately, Marshfield Police Officers located the Defendant and conducted a traffic stop. During the course of the stop, the investigating officer observed the Defendant to have bloodshot eyes, slurred speech, and an odor of alcohol about his person. In addition, the Defendant stated that he was "blasted" and had "messed up." After the Defendant failed a series of field sobriety tests, he was placed under arrest and charged with operating under the influence of alcohol.
Notwithstanding all of the above, Attorney Ciraulo was able to challenge the state of the evidence and defeat the allegations against the Defendant as the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt. As such, the Defendant was found Not Guilty after trial.
