NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Peabody District Court; Commonwealth v. J.A.; May 14, 2025
Massachusetts State Police Troopers were dispatched to a motor vehicle crash on Route 1 in the town of Danvers. Upon arrival, the officers learned that the Defendant failed to stop at a red light and crashed into the side of another motorist. While the Defendant was able to free himself from the wreck, the other motorist needed the assistance of the fire department to free himself from the heavily damaged SUV. While interacting with the Defendant, the investigating officer observed an odor of alcohol about the Defendant. The Defendant acknowledged that he consumed gin and tonics with friends at the Encore Casino. Thereafter, the Defendant was unable to perform the field sobriety tests. Ultimately, the investigating officers formed the opinion the Defendant was under the influence of alcohol and the Defendant was placed under arrest, handcuffed, searched, and transported back to the station for processing.
Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officer and challenge the state of the evidence. Ultimately, Attorney Ciraulo was able defeat the allegations against the Defendant, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt, and the Defendant was found Not Guilty after trial.
