Operating Under the Influence of Alcohol; Barnstable District Court; Commonwealth v. K.B.; September 23, 2026 

While engaged in traffic enforcement duties, Yarmouth Police executed a motor vehicle stop after observing the Defendant tailgating another car and committing a series of marked lanes violations. The Officers thereafter conducted a motor vehicle stop, approached the Defendant's car, and engaged in conversation. The officers immediately observed a strong odor of alcohol about the Defendant as well as bloodshot and glassy eyes, slurred speech, and compromised coordination. The Defendant first denied consuming alcohol, but thereafter admitted to having one or two drinks. The Officers thereafter ordered the Defendant out of the car and administered the Nine Step Walk and Turn and One Leg Stand Field Sobriety Tests. The Officers determined that the Defendant did not properly complete / pass the field sobriety tests, formed the opinion that the Defendant was under the influence of alcohol, and placed the Defendant under arrest. 

Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officers, challenge the state of the evidence, and defeat the allegations against the Defendant. As such, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
