NOT GUILTY AFTER TRIAL

Barnstable Police were tasked to investigate a report of an individual threatening to extort money from members of his family. During the course of the investigation, it was reported to Barnstable Police that the Defendant, upon his mother's passing, challenged the terms of his mother's will. It was further reported that the Defendant made threats to expose alleged financial and sexual misconduct of certain family members if the terms of the will were not modified.
On cross examination of the family members, Attorney Ciraulo successfully established the witnesses' inconsistent statements and motive to fabricate and / or exaggerate. In addition, Attorney Ciraulo successfully challenged the credibility of the witness statements and called into question the plausibility of their account. As such, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
