NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Barnstable District Court; Commonwealth v. C.J.; July 1, 2026
While on patrol, a Sandwich Police Officer observed the Defendant's vehicle cross over the white fog line, turn sharply back in a jerking manner, cross over the double yellow center dividing line, and once again turn back in a sharp jerking manner. Having observed the marked lanes violations and erratic driving, the Officer conducted a stop of the Defendant's vehicle. The Defendant gave the Officer a credit card instead of this license, smelled of alcohol, and presented with slow, lethargic, and slurred speech. The Defendant admitted he had consumed alcohol and was ordered out of the vehicle. Once outside of the car, the Defendant was unsteady on his feet, used the side of the car for balance, and failed each of the field sobriety tests. The Officer formed the opinion that the Defendant was intoxicated and placed him under arrest.
Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officers, challenge the state of the evidence, and defeat the allegations against the Defendant. As such, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
