Operating Under the Influence of Alcohol / Operating Under the Influence of Drugs; Plymouth District Court; Commonwealth v. T.L.; May 18, 2023
Massachusetts State Police were dispatched to investigated a reported "road rage" incident and motor vehicle crash on Route 3 in Plymouth. Upon arrival, the Troopers observed two heavily damaged vehicles. The reporting party informed the officers that the Defendant was traveling at a high rate of speed, was changing lanes dramatically, and had struck the rear passenger side of his car causing him to lose control. During the course of the investigation, the Troopers observed the Defendant to smell of alcohol and had difficulty answering basic questions. The Defendant was unable to recite the alphabet and failed both the Nine Step Walk and Turn and One Leg Stand Field Sobriety Tests. The Troopers then located inside the Defendant's vehicle a quantity of open and unopened containers of alcohol as well as a quantity of marijuana. The Defendant was thereafter placed under arrest and charged with Operating Under the Influence of Alcohol and Operating Under the Influence of Drugs.
Notwithstanding all of the above, the Commonwealth was unable to answer ready for trial and the case was Dismissed.
