Operating Under the Influence of Alcohol, Boston Municipal Court, Dorchester Division; Commonwealth v. M.A.; September 20, 2023

Massachusetts State Police observed the Defendant traveling at a high rate of speed and made a stop of his vehicle. The investigating officer approached the Defendant and observed about him an odor of alcohol, bloodshot eyes, and slurred speech. After the Defendant admitted to consuming four to five drinks, the officers ordered the Defendant out of the car and administered to him field sobriety tests. The Defendant was ultimately arrested and consented the breath test at the police station. The Defendant's blood alcohol content (BAC) was .08. The Defendant was charged with Operating a Motor Vehicle Under the Influence of Alcohol.

Notwithstanding all of the above, the Commonwealth was unable to answer ready for trial and the case was Dismissed.
