Operating Under the Influence of Alcohol, Second Offense; Hingham District Court; Commonwealth v. M.G.; August 24, 2023
Hull Police Officers were flagged down by a pedestrian who reported that the Defendant was operating erratically and had struck a curb. The investigating officers located the described vehicle and observed the Defendant commit multiple marked lanes violation and run a stop sign. The police then stopped the Defendant, made observations of her person, and administered to her field sobriety tests. The Defendant consented to a Portable Breath Test and the reading was .25. The Defendant was arrested and charged with Operating a Motor Vehicle Under the Influence of Alcohol, Second Offense and Negligent Operation.
Notwithstanding all of the above, the Commonwealth was unable to answer ready for trial and the case was Dismissed. Attorney Ciraulo then filed and the Court allowed a Motion to Reinstate the Defendant's License.
