NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Taunton District Court; Commonwealth v. J.C.; January 17, 2024
Taunton Police were dispatched to the area of Main Street for a reported motor vehicle crash (truck v. parking meters and light post). When the officers arrived on scene, the Defendant was observed walking away and trying to leave. After given commands to stop, the Defendant became uncooperative, agitated and aggressive. The Defendant was observed to have blood shot and glassy eyes, slurred speech, and an odor of alcohol about his person. The Defendant admitted to have 5-6 drinks and said to the police officers, "You Got Me!"
Notwithstanding all of the above, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
After the Defendant was acquitted of the charges, Attorney Ciraulo filed and the Court allowed a motion to reinstate / restore the Defendant's driver's license as said license was suspended as a result of his refusal to perform the breath test.
