NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol, Malden District Court; Commonwealth v. A.M..; September 27, 2023
Everett Police Officers were dispatched for a reported motor vehicle accident. Upon their arrival, the officers observed a heavily damaged and overturned SUV in the roadway. During the subsequent investigation the officers learned that the Defendant struck two parked motor vehicles and thereafter flipped his SUV onto its roof. The Defendant reported to police that he had "at least two" drinks and the officers observed about him an odor of alcoholic beverage. In addition, the Defendant presented with slurred speech, blood shot and glassy eyes, and was unsteady on his feet. The Defendant failed to perform the field sobriety tests to the satisfaction of the investigating offices and was placed under arrest for Operating Under the Influence of Alcohol.
Notwithstanding all of the above, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt and the Defendant was found Not Guilty after trial.
