NOT GUILTY AFTER TRIAL
Operating Under the Influence of Alcohol; Attleboro District Court; Commonwealth v. N.G.; April 17, 2025
While traveling behind the Defendant, a Norton Police Officer observed her vehicle cross over the double yellow center line, swerve into the oncoming lane of travel, swerve back into the correct lane of travel, and thereafter cross over the solid white fog line. The Officer stopped the Defendant and observed about her a person a strong odor of alcohol. In addition, the Defendant's speech was slurred and she had bloodshot and glassy eyes. On the floor next to the Defendant were a combination of full and empty alcohol "nip" containers and there was a package of alcoholic seltzers partially consumed on the back seat. The Defendant stumbled as she got out of the car, grabbed onto the car door for balance, and thereafter failed each of the field sobriety tests administered to her. The investigating officer formed the opinion the Defendant was under the influence of alcohol and the Defendant was placed under arrest, handcuffed, searched, and transported back to the station for processing.
Notwithstanding all of the above, Attorney Ciraulo was able to rebut the opinion of the arresting officer and challenge the state of the evidence. Ultimately, Attorney Ciraulo was able defeat the allegations against the Defendant, the Commonwealth was unable to meet the heavy standard of proof beyond a reasonable doubt, and the Defendant was found Not Guilty after trial.
